Clear expectations create stronger creative work. These policies exist to protect both the client and Critical Graffix throughout the design process.
Project Agreements
All substantial commercial design work performed by Critical Graffix requires a signed Project Agreement before production begins.
Verbal agreements, undocumented arrangements, text-message-only understandings, and informal project assumptions are not accepted for major commercial work.
Project Agreements establish:
- Scope of work
- Revision structure
- Deliverables
- Production schedule
- Ownership rights
- Payment milestones
- Project procedures
Deposits & Scheduling
Most commercial projects require an upfront non-refundable deposit before scheduling begins.
Projects are officially placed into the production schedule only after:
- Project Agreement approval
- Signed documentation
- Deposit clearance
Critical Graffix reserves the right to delay scheduling until payment processing has fully cleared.
Revisions & Scope Changes
Projects include structured revision rounds appropriate to the agreed scope of work.
Excessive revision cycles, repeated redesign requests, major directional changes, or expanded project scope beyond the original agreement may result in additional billing.
Significant additions or scope changes may require revised timelines and updated agreements.
Ownership & Rights
Preliminary concepts, drafts, mockups, unused variations, and working production files remain the intellectual property of Critical Graffix unless otherwise agreed in writing.
Ownership rights to approved final deliverables transfer only after final payment has been completed.
Editable/source files are not automatically included unless specifically stated in the Project Agreement.
Trademark, Legal Review & Client Materials
Critical Graffix does not provide legal trademark clearance, copyright opinions, intellectual-property legal review, or business-name availability verification services.
Clients are solely responsible for conducting trademark, copyright, business-name, and legal availability reviews prior to commercial use, registration, manufacturing, publication, or distribution.
Clients represent that supplied text, imagery, logos, photographs, artwork, slogans, marketing claims, and other provided materials are authorized for commercial use and do not knowingly infringe upon the rights of third parties.
Critical Graffix is not responsible for legal claims, disputes, damages, or liabilities arising from client-supplied materials, unauthorized content, trademark conflicts, or post-delivery commercial usage.
Completion and delivery of final files concludes the original project scope unless otherwise agreed in writing. Ongoing revisions, future edits, maintenance, support, troubleshooting, or additional production work are not implied beyond the original agreement.
Portfolio & Promotional Rights
Critical Graffix reserves the right to display completed publicly released work, selected design process materials, previews, concepts, and related project imagery for portfolio, promotional, website, social media, educational, and professional showcase purposes unless otherwise agreed in writing prior to project commencement.
Displayed portfolio work may include conceptual presentation environments, mockups, simulated signage, illustrative branding applications, or stylized demonstration materials created for presentation and promotional purposes.
Confidential & NDA-Friendly Projects
Critical Graffix understands that certain projects may involve confidential, unreleased, or sensitive materials.
Confidentiality accommodations and NDA-friendly workflows can be arranged through written agreement prior to production.
Payments
Approved client payments may be processed through PayPal Business, Venmo Business, or other approved electronic payment methods.
Critical Graffix does not accept payment forwarding arrangements, overpayment requests, or third-party financial routing arrangements.
Final production files may be withheld until all outstanding balances have been paid in full.
Critical Graffix does not guarantee exclusivity against independently created or AI-generated similarities produced elsewhere.
Project Cancellation
If a project is canceled after work has begun, completed work and invested production time remain billable.
Deposits already paid are non-refundable unless otherwise stated in writing.
Unused concepts, unfinished drafts, and production materials remain the property of Critical Graffix.
Turnaround Times
Estimated turnaround times are provided in good faith but may vary depending on project complexity, revision volume, communication delays, scheduling, and workload.
Critical Graffix is not responsible for delays caused by incomplete client materials, delayed approvals, or scope expansion.
Delays caused by illness, emergencies, technical outages, severe weather, platform failures, or circumstances beyond reasonable operational control may affect estimated timelines.
Digital & AI-Assisted Tools
Critical Graffix may utilize modern digital production tools, automation systems, and AI-assisted creative workflows as part of the design and ideation process.
Final creative direction, editing, refinement, production decisions, and client deliverables remain under direct human supervision and artistic control.
Critical Graffix does not provide large-scale speculative work or unpaid production concepts outside approved project agreements.
Privacy & Communication
Information submitted through this website or through project communications is used solely for communication, project management, invoicing, scheduling, and production purposes.
Critical Graffix does not sell client information to third parties.
Clients are responsible for reviewing and approving final spelling, grammar, contact information, pricing, factual content, and production details prior to release or printing.
Printed colors and output appearance may vary slightly depending on monitor calibration, printer hardware, paper stock, inks, coatings, and production processes.
Clients remain responsible for third-party hosting, domain registration, platform subscriptions, and external service costs unless otherwise agreed in writing.
Critical Graffix is not responsible for indefinite archival of completed project files. Clients are encouraged to maintain secure backups of all delivered materials.
Critical Graffix reserves the right to decline projects involving unlawful activity, plagiarism, hate speech, abusive conduct, or intentionally deceptive materials.
